Initial impression of UK Gove Statement of Reasons for #Section35 Order - 2 key legal problems (i.e., without prejudice to the obvious moral concerns): 1. Main argument is essentially "Gender recognition rules will be different in Scotland from England and this will cause administrative challenges". Which is fine but lots of legal regimes are different between England and Scotland, many of these touch on reserved matters, and this causes lots of administrative challenges. Why is the GRC regime different (other than for political/ideological reasons) from any other regulatory regime? 2. It misunderstands the effect of the Equality Act 2010. That Act makes provision for discrimination re. protected classes where it is, inter alia, proportionate. Those provisions would, basically, solve all the issues raised around single sex spaces and likely most of the administrative challenges. Of the many times the Scot Parl has passed legislation with impacts on reserved matters, it is not clear why this particular issue (from a legal perspective) justifies a S.35 Order. #legal #GenderRecognitionReformBill
